Hi,
I have a couple of questions regarding ownership of the marital home.
My was caught being unfaithful and now wants to divorce. The home is owned by myself, I pay the mortgage and it’s my name on the deeds. So firstly, is she entitled to a 50/50 split and second, is she entitled to remain in the home? We have children living in the home all over the age of 16.
Any help appreciated

These three things are irrelevant:-
1. That your wife has been unfaithful,
2. That the house is in your sole name and
3. That you pay the mortgage.

None of these things will make the slightest difference to the outcome. They are irrelevant. What your wife will be entitled to will depend upon factors such as how long you have been together, your respective ages, your respective needs and resources, how many children there are and whether any or all of them are still in full time education. In any individual case other factors may be relevant but the ones mentioned certainly matter within the context you have described.
