financial consent order rejection?
August 13, 2024 09:00AM
I will soon be getting the financial Consent Order completed by s solicitor and just wanted to know if there is any chance of judge rejecting.
We have 1 child and custody will be 50/50.
The only asset is FH which I will be staying in and giving ex lump sum payment of approx 40% of equity in house.
The lower amount being due my family gifting a large sum to purchase the property 3 years ago (he is more than happy with this).
My income is slightly higher than his (approx 3k annual) and he has a larger pension than me by approx £6k but both pensions are very small so we have agreed not to include these.
We have both taken legal advice but have decided on the above split between us.
Is there any chance a judge would not accept this?

There is always a chance just as there is always a chance of being run over by a bus but there is no reason to suppose that terms of settlement like these would not be approved. Provided a settlement is not grossly unfair judges will not usually reject terms which both sides are happy with, which are broadly fair and where both sides have taken (or had the opportunity to take) legal advice.
