Hi and thank you for a great for a great forum..

Me and my wife are considering divorce.

We have 2 property's one main residence in both our names and a buy to let flat in my name .

We have amicably discussed potentially me taking on the main residence and my wife taking on the buy to let all being well with affordability checks and changing the mortgage over to a residential mortgage for her.

My question is would there be any capital gains tax if we did this?

You really need to speak to an accountant about capital gains tax but so far as I am aware there would be no capital gains tax consequences as a result of doing this. However, please note that for this to be true any such transfer has to take place within a certain period of time after separation (if at some point you do separate).
