How to find out if (ex) partner filed for legal separation
October 29, 2020 11:44AM
Hello,

I'm Theo from the Netherlands.

How can I find out if my (ex)partner filed for a legal separation or divorce in the UK?
I find out that I can ask court to search for a decree absolute. Will this procedure also find any legal separation or decree nisi?

I'm looking forward to your reply.

With kind regards,

Theo

The only thing you can search for is decree absolute because only that (or death) dissolves a marriage. You cannot search for decree nisi because decree nisi does not end a marriage. Nor is there really such a thing as 'legal separation'. Separation is a matter of fact. People are either separated or they are not. There is no register recording such things. It is true there is something called a decree of judicial separation but those are extremely rare and tend only to be used in cases where both spouses have some sort of objection to divorce.
