Final Order and non-molestation order

Good evening,

I've had the conditional order for a while now. Eventually my partner provided Form D81 and everything else to sort the finances out (we are going for a clean break). I now have received the approved Clean Break/Consent Order from HMCTS and would like to apply for the final order as soon as possible.

Because of the abuse I've been getting on a daily basis I am preparing to file for a non-molestation order. Is it correct that the non-molestation order has nothing to do with the final order? Can I file for the final order now or should I wait until the non-molestation order has been filed?

It is correct, yes.

Since a non-molestation order can be obtained against a perfect stranger when you apply for a final order of divorce is unrelated to when you can apply for a non-molestation order.

I will mention one thing though. It is that now the financial issues arising from the marriage have been settled and you will shortly have a final order for divorce it may well be that you do not need a non-molestation order. Typically these things stop - not necessarily immediately - after these things have been settled. It may be a good idea to actually wait and see for a while unless for some reason there is a serious threat of harm.
