Is that timeframe realistic?
March 29, 2022 04:56PM
Hi everyone

My purpose is to get a legally binding agreement for the financial side of things (so a Consent Order) before early July, when my mortgage offer expires.

We applied for a divorce around March 20th. We are waiting to hear back from them.
I need the divorce proceedings to start officially to request my state pension cash equivalent and then complete form 81 (the financial circumstances details).

In a nutshell: is it realistic to believe a Consent Order can be reached within 90 days?

Many thanks

You can lodge a financial settlement with a court for turning into a court order at any time from decree nisi onwards. In theory this timescale is possible but with the way the courts are operating now I don't think you can count on it. You will need to make sure the acknowledgement of service of the divorce petition is returned to the court just as soon as it is received.

If my experience is anything to go by I think you’ll be lucky. I’m still waiting for the consent order to be agreed by the courts and the Absolut issued 9mths down the line.

I hope your case is different though. Good luck

If the financial split has been reached amicably, then could a zydhias agreement work?
The finances(apart from pension) can be split up before the decree nisi, and the open letter of agreement should prevent them from getting a second bite.
Not ideal, but, given Court delays, practical.
