What's your view on people who break court orders David? Should there be a penalty for doing so?by Genesis01 - UK Divorce Forum
Very true, and sadly I know of a few fathers who have court orders in place to see their children and yet are still refused contact by the mother for reasons of "just because". In the instance of my ex and I going to court and receiving a court order explicitly stating holidays I do think that she would stick to them (thankfully). It's heartbreaking to have to spend 2 years fighby Genesis01 - UK Divorce Forum
It's shameful on the part of the other parent to deny contact though, without any good reason. Hopefully in court I'll be able to show that she can't be trusted to allow me to see my children during holidays and make a court order to take the decision out of her hands.by Genesis01 - UK Divorce Forum
Long story short - in the summer my children confided in me that their mother (who has residency of the children) had abused them and the police got involved. The mother was subsequently charged by police although the charges were later dropped. During this time I refused the children any contact with her until the case was resolved as I had concerns about coercion. The children were subsequentlyby Genesis01 - UK Divorce Forum
My ex has been charged with child abuse against my children, and in court on Wednesday I was granted interim residency of the children (I had already kept the children for a month when the allegations were investigated) ,but we had an issue of determining where the children would attend school, so we went back to court on Friday. On Friday back in court her solicitor misrepresented a telephonby Genesis01 - UK Divorce Forum
Yeah, I've already done that. Beds etc. are on their way. It's just that financially it's quite a hit to get a new flat kitted out, especially when there is stuff for the kids already at their old house.by Genesis01 - UK Divorce Forum
Divorce still continuing, whereby ex lives in house with the children. 2 weeks ago, however, things took a big twist and I'm now looking after the children. I'm scurring around trying to find somewhere to live for us all, and have just managed to secure an unfurnished private rent in another town. When it comes to getting the beds for the children, are they classed as a marital assetby Genesis01 - UK Divorce Forum
Thanks David. It's certainly very helpful to see how solicitors/courts view things as compared to the parties involved in the divorce.by Genesis01 - UK Divorce Forum
I'm still at the finances part of getting divorced, and would be interested to read thoughts on the 4 points listed below... Person A took out a loan and credit card but did not tell Person B about them during marriage. Person A claims this was to cover shortfalls in finances when money was tight. Person B reluctant to accept this and would like reassurance by asking for receipts for purcby Genesis01 - UK Divorce Forum
Thanks for your response David, it's very helpful. I presume then that if the resident parent complained to the court that splitting the children is unfair, it could result in a costly battle whereby the ex could dispute this? Would the court not look more favourably towards having all siblings together during contact? Wouldn't the ex need to justify themselves as to why they are onlby Genesis01 - UK Divorce Forum
Court order was granted over a year ago that decided who had residency of children. Ex partner was to get every second weekend and during holidays with specific pick-up and drop off times. Since court order, ex partner splits children up with half going to ex-partners house and the others going to ex-partners parents house (different towns). In some cases it is months between some children speby Genesis01 - UK Divorce Forum
