Obviously you have grounds for divorce so you can divorce your husband any time you want. Also, obviously nothing compels you to continue to live with him and choosing to leave if you wish. Whether you can force him to leave so that you get to stay in the flat is another matter. There are two routes to that outcome. (1) You make an application for the transfer of the tenancy to you in a financial application during the divorce. That will take time (probably at least a year) and cost money. Also, during that time you will continue to live in the flat with your husband which may be rather unpleasant. There is also no certainty that a court would think it more appropriate that the flat be transferred to you than to him. (2) You could get an occupation order IF he is violent towards you or has threatened violence towards you. If neither has happened then you would have no grounds for an occupation order. In any event an occupation order would likely to time limited to enable you time to effect option (1).
