We have had several FDRs and an attempted Final Hearing that was an FDR because my wife's solicitor didn't submit the 560 page court bundle until 3 hours before the hearing.
My question is this...
Following most of. the hearings, my wife's solicitor was responsible for drafting the court order. In the early days, I said nothing, but in the last few hearings, the solicitor has included the direction of the court stated at the hearing by the judge. However, they have generally included additional demands of myself. At the last hearing, and the hearing from 3 weeks ago, i replied to the solicitor and the court, with details of any issue I had with the draft order.
Both times, her solicitors never responded (thus far), hence there has not been a court order for either hearing sealed by the court. (I think sealed is the correct term). However, my wife's solicitor has proceeded to present the court order to third parties as if it were agreed and issued by the court.
Is it legal for them to do so? To me it would appear to be misrepresentation? Is this something that can be complained about in court?
